Peter Maverick recently obtained a defense verdict in a six day jury trial in Miami, Florida. At issue were claims that Mr. Maverick's client allegedly defrauded the plaintiff, breached a partnership agreement, and violated an agreement, dedicated civil theft, and committed the tort of conversion of property. Mr. Maverick’s client denied any wrongdoing. After closing arguments on the sixth day of trial, the jury deliberated for several hours. It reached a verdict that Mr. Maverick's client prevailed as to all issues.
Critical to prevailing at challenge was Mr. Peter Maverick cross assessment of the plaintiff. The jury observed first-hand the plaintiff's accusations and credibility. Cross examination exposed trustworthiness problems with the plaintiff, and that likely had a most important impact on the jury's evaluation of the plaintiff's claims. Moreover, some of the plaintiff's supposed supporting witnesses contradicted the plaintiff's account when they were questioned at trial. Other witnesses that were supposed to back up the plaintiff seemed less than credible when they were cross examined.
The plaintiff's lawyer's closing argument was largely dedicated to attacking the credibility of Mr. Maverick’s client. However, in his final words, Mr. Maverick argued that the evidence simply did not hold up the plaintiff's claims. There were main infirmities. For example, the plaintiff had made prior contradictory statement with his own testimony at challenge. Beyond that, the plaintiff failed to produce critical document evidence that one would expect when strong accusations of fraud and theft are alleged in a business litigation jury trial.
